Can you get permanent stay through employment?

Consecutive qualifying years on a work KITAS open the door to permanent stay. Continuity is the whole requirement and it is easy to break.

Permanent stay through employment is the least discussed KITAP route and the one that applies to people who came to Indonesia for a job and stayed.

How it works

Broadly, by holding a work KITAS continuously for a qualifying period, sponsored by an Indonesian employer, and then applying for KITAP, the permanent stay permit.

The qualifying period varies by category and has been subject to change, so verify the current requirement rather than relying on older guidance or on what a colleague did some years ago.

What changes when you get it

Longer validity and simpler renewal, instead of an annual process tied to a sponsor.

Greater stability. A work KITAS ends when the employment ends. KITAP is a more settled status, which matters considerably if you have a family, a home and assets here.

Easier practical life. Banking, contracts, school enrolment, tax registration and property matters are all less friction-heavy with permanent status.

Hak Pakai becomes available — a registered right of use over property in your own name at the land office, which is the strongest ownership position open to a foreign individual and is not available without residency.

What does not change

KITAP is a stay permit, not an unrestricted right to work.

This is the most commonly misunderstood point. Permanent stay governs your right to be in Indonesia. Working for an Indonesian employer still engages the foreign worker framework — RPTKA approval and the corresponding authorisation — and certain positions remain closed to foreign nationals.

Do not assume that permanent residence converts into a free hand to take any job or to run a business operationally. Establish the position explicitly before you act on it.

"Continuous" is the difficult word

The qualifying period requires continuous KITAS holding, and the gaps that reset it are ordinary rather than exotic.

A late extension that lapsed for a fortnight. A change of employer that required a new permit rather than an extension. A period abroad beyond what the permit allowed without the correct re-entry position. An employer whose own compliance failed, taking the permits it sponsored with it.

Any of those can cost you the clock. If permanent residence is the objective, treat every renewal date and every employment change as consequential.

The employer dependency

A work KITAS is tied to its sponsor, which means your progress toward KITAP depends on an employer's continued existence and compliance.

A sponsoring company with missed LKPM quarterly filings, outstanding tax returns or an inactive NIB has a standing problem, and it attaches to the permits it sponsors. Employees with immaculate personal paperwork get caught by this.

If you are counting years toward KITAP, it is reasonable to ask your employer to confirm the company's filings are current. It is your immigration position, not just their administration.

Changing jobs

A work permit is tied to a position and a sponsor and is not transferable. Changing employer means a new RPTKA and a new permit, not a transfer of the old one.

Sort the new permit before the old employment ends, not after. A gap between permits is both an overstay risk and a reset of the KITAP clock.

The tax position

Holding KITAP and living here means you are almost certainly an Indonesian tax resident — broadly 183 days in a twelve month period, or presence with intent to reside.

That has consequences in both directions: a favourable rate on Indonesian-source rental income at ten percent final rather than twenty percent non-resident, and engagement with your home country's worldwide income rules, exit taxation in several European jurisdictions, and continuing US obligations for American citizens regardless of where they live.

Plan it deliberately rather than discovering it.
