How does the Indonesian spouse visa work?

Marriage to an Indonesian citizen opens a residence route, and eventually KITAP. It does not by itself grant the right to work.

Marriage to an Indonesian citizen is the most stable residency route available to a foreigner in Indonesia, and it comes with one limitation people consistently misread.

What it gives you

A KITAS sponsored by your Indonesian spouse, rather than by an employer. That is the significant difference: your residency is not tied to a job, so losing or changing work does not end your permit.

It is renewable, and after holding it continuously for a qualifying period you can generally apply for KITAP, the permanent stay permit, which brings longer validity, simpler renewals and a considerably more settled position.

What it does not give you

The right to work. A spouse KITAS is a residence permit. Taking employment with an Indonesian company still requires the employer to obtain RPTKA approval and the corresponding work authorisation.

There is a widely repeated belief that a spouse KITAS or KITAP allows you to work freely. Treat that as something to verify against the current rules rather than to act on, because the consequences of getting it wrong fall on you and on your spouse as sponsor.

If you intend to work, establish the position explicitly before you start, and get it in writing from someone who will still be reachable later.

What the application involves

A legally recognised marriage. Where the marriage took place abroad, it generally needs to be reported and registered in Indonesia, and that reporting is frequently the step people have not done.

Your spouse as sponsor, with their identity documents, family card and supporting evidence.

Proof of the relationship, which can extend beyond the certificate to photographs, correspondence and evidence of a genuine shared life.

Address and domicile documentation.

Post-arrival reporting, including registration and usually an SKTT domicile certificate.

Processing is not fast, and incomplete documentation is the main cause of delay rather than the decision itself.

The document that matters more than the visa

If you are married to an Indonesian citizen, the prenuptial or postnuptial agreement is more consequential than the visa.

Indonesian marital property rules treat assets acquired during the marriage as jointly held. Because a foreigner cannot hold Hak Milik, that joint interest compromises your Indonesian spouse's ability to hold freehold in their own country.

A registered agreement separating the estates fixes this. Since the Constitutional Court decision in 2015, it can be made after the wedding as well as before.

Couples routinely sort the visa and leave this, and it is the wrong way round. The visa affects where you can live. The agreement affects whether your spouse can own land.

Divorce and death

A spouse KITAS is sponsored by the marriage. If the marriage ends, the basis for the permit ends with it, and there are rules about the period in which you must regularise or leave.

On death, the surviving foreign spouse faces both an immigration question and an inheritance question — a foreigner cannot hold Hak Milik, so inherited freehold is subject to disposal rules within a defined period.

Neither is comfortable to plan for and both are much easier handled in advance. An Indonesian will, a registered marital property agreement, and a clear understanding of the permit position are the three things that make a difficult moment survivable.

For property

A spouse KITAS gives you residency, which means Hak Pakai becomes available to you — a registered right of use in your own name at the land office, subject to the minimum value requirements. That is the strongest ownership position available to a foreign individual and it is not open to anyone without residency.

It also makes opening a bank account, obtaining an NPWP as a resident taxpayer and dealing with utilities substantially easier.

Common questions

Can I work in Indonesia on a spouse KITAS?

It is a residence permit, not a work authorisation. Employment with an Indonesian company still requires RPTKA approval and the corresponding permit, so verify the current position before starting work.

How long until I can get KITAP through marriage?

After holding a spouse KITAS continuously for a qualifying period. Verify the current requirement, as immigration rules change.

Does marrying an Indonesian let me own property?

No. You still cannot hold Hak Milik. Residency does make Hak Pakai available, which is a registered right in your own name.

Do I need a prenuptial agreement if I marry an Indonesian?

If you want your spouse to hold freehold cleanly, yes. Without one, joint marital property rules create an impermissible foreign interest. It can be made after the wedding too.

What happens to my KITAS if the marriage ends?

The permit is sponsored by the marriage, so its basis ends with it, and there are rules about the period in which you must regularise your status or leave.
