How does an Indonesian passport work for dual nationals?

A child of a mixed marriage can hold both until eighteen. After the declaration period, one goes, and which one decides whether they can ever own land here.

Indonesia does not generally permit dual nationality. The main exception runs through childhood and ends with a deadline that families miss.

The window

Under the 2006 citizenship law, a child of a marriage between an Indonesian citizen and a foreign national may hold limited dual citizenship until the age of eighteen, plus a period afterwards — commonly described as up to three years — within which the child must declare which nationality they choose.

During that window the child can hold both passports, travel on either, and is treated as Indonesian in Indonesia.

If no declaration is made within the period, the Indonesian citizenship is generally lost.

Why it matters more than an identity question

An Indonesian citizen can hold Hak Milik, Indonesian freehold. No foreigner can, ever, under any structure.

So the declaration at eighteen decides whether that person can own land in Indonesia for the rest of their life.

For a family with property here, that is an inheritance and asset-holding decision. A child who declares foreign nationality becomes a foreign heir, and where a foreigner becomes entitled to Indonesian freehold through inheritance, disposal rules apply within a defined period.

A child who retains Indonesian citizenship does not have that problem.

Getting it right from the start

Register the child's status properly. Where the birth occurred abroad, it must be reported to the Indonesian representative in that country and registered here, within time limits. Documents need legalisation — by apostille, since Indonesia is a party to the Hague Convention — and sworn translation.

A child whose Indonesian status was never registered may not have the dual position at all, which removes the choice before it is ever made.

Obtain the Indonesian passport and keep it current through childhood, because it is the practical evidence of the status.

Keep the documents together — birth registration, both passports, the parents' marriage registration — somewhere reachable from another country.

The deadline, practically

Diarise the eighteenth birthday and the declaration deadline. Put it somewhere that survives house moves, changes of email address and the child leaving home.

This is the single most useful thing in this article. Families lose the entitlement through nothing more than nobody having written the date down.

Making the declaration

It is a formal process, and the consequences are permanent.

Take advice before it, because the decision has property, inheritance, tax, military service and travel implications that differ by the other nationality involved.

Consider what the young person actually wants, not only what is convenient. They are the one living with it.

Travelling on two passports

While the window is open, a dual national child can travel on either, and the practical rule is to enter and leave Indonesia on the Indonesian passport and use the other elsewhere.

Mixing them — entering on one and leaving on the other — produces immigration record inconsistencies that cause problems later, including at the declaration.

If citizenship was already lost

A former Indonesian citizen, and in some routes a descendant of one, may access immigration routes that are more straightforward than those open to an unconnected foreign national.

Recovering citizenship is a separate and demanding process, and it means giving up the other nationality. It is worth understanding before committing capital to a thirty year lease, because holding Hak Milik and holding a wasting leasehold are not comparable positions.

Residency alone, without citizenship, still makes Hak Pakai available — a registered right of use in your own name, which is the strongest position available to a non-citizen.
