Is a Bali leasehold registered anywhere?
Hak Sewa appears on no certificate and in no government register. Your entire protection is the notarised deed, which changes how you verify everything.
This is the single most important technical fact about Bali property for foreign buyers, and almost nobody explains it before the deposit.
The fact
Hak Sewa is not registered at the land office. It does not appear on the land certificate. There is no government record that you hold an interest in that parcel.
Compare that to Hak Milik, HGB and Hak Pakai, all of which are registered rights recorded at BPN and shown on a certificate.
Your lease exists as a notarial deed. That document, and the notary's record of it, is the entirety of the evidence that you have any interest in the land.
What follows from it
No bank will lend against it. A lender needs registered collateral it can enforce against. There is none, which is the main reason Bali is a cash market and why most buyers fund from abroad.
A title search will not show you. Anyone inspecting the certificate — a prospective buyer of the land, a creditor, a court — sees the landowner and no trace of your interest. You are invisible to the register.
A subsequent purchaser of the land is not automatically bound. If the landowner sells the land, whether the new owner has to honour your lease depends on whether the deed binds successors and whether you can enforce it. This is drafting, not registration.
You cannot rely on the register to protect you. In a registered system, registration itself is your protection. Here it is the contract, which means the contract has to do all the work.
How this changes your verification
In a registered system you check the register and the register is the answer. Here you have to check three separate things.
The land itself, at the land office. The certificate, the registered owner, the area, the boundaries and any registered encumbrance. This establishes that the person leasing to you owns what they say they own and that nothing registered sits ahead of you.
The counterparty. That the person signing is the registered owner or holds a valid, current power of attorney, and that a married landowner's spouse consents.
The deed itself, in detail, because it is your only protection. Term, extension mechanism, assignment, sublease, right to build, succession, remedies.
And then a fourth, informal one: ask locally. The banjar will know about disputes, competing claims and history that no document search will surface.
What has to be in the deed because it cannot be in a register
Binding on heirs and successors, so that a change of landowner does not end your position.
A guaranteed extension — jaminan, not prioritas — with a stated term and a fixed price or published formula.
A right to assign and sublease, without which you have no exit and no income.
An express right to build, with an obligation on the landowner to sign permit applications within a defined time, and a power of attorney so you are not dependent on their cooperation.
Ownership of improvements during the term, and what happens to them at expiry.
Full payment of the whole term recorded, so no later claim of arrears is possible.
Named remedies. Specific performance and a defined compensation figure if the landowner obstructs, sells or refuses.
Every one of those exists because there is no register doing the job for you.
Where to keep the document
The original deed, with the notary. A certified copy, with you, somewhere reachable from another country. A sworn translation alongside it.
If you cannot produce the deed years later, you have a problem that is genuinely difficult to solve, because there is no register to fall back on. Buyers underestimate this and then discover it when they try to sell.
Is this a reason not to buy leasehold?
No. Most foreign-held property in Bali is leasehold and most of it is fine. It is the fastest and cheapest lawful route into the market and it is used by serious buyers constantly.
It is a reason to treat the drafting as the product rather than a formality, to engage your own notary rather than the agent's, and to spend a few thousand dollars having the deed reviewed properly. In a system with no register protecting you, that review is the protection.
